$300,000 'Success Bonus' for Five-Day Mediation? Not So Fast, Says Jury

A federal jury found that a "success bonus" clause in a $600-an-hour Connecticut divorce lawyer's fee agreement was in breach of the agreement's implied covenant of good faith and fair dealing. Nationally renowned ethics expert Geoffrey C. Hazard Jr. said the "only possible justification" for the $300,000 bonus for a five-day divorce mediation "was that it was like a contingent fee for negotiating a good result," but contingent-fee litigation is not permitted in divorce practice.
